Massey Energy sues state Supreme Court over FOIA
CHARLESTON, W.Va. (AP) — Massey Energy is suing the West Virginia Supreme Court for its refusal to release Justice Larry Starcher’s e-mails, claiming the decision violates the state’s Freedom of Information Act.
The Richmond, Va.-based coal company filed an FOIA request with the court earlier this month seeking e-mails between Starcher, his staff, the court’s administrative staff and any third parties that refer to Massey Energy or its chief executive, Don Blankenship.
In its lawsuit, Massey claims court administrator Steve Canterbury failed to provide a reason why the e-mails are exempted from disclosure under FOIA. The lawsuit was filed last Friday in Kanawha County Circuit Court.
