Waverly man charged with vehicular assault

A Waverly, W.Va., man has been charged with aggravated vehicular assault as the result of a two-vehicle accident in Belpre last month.

According to a release from the Washington County Sheriff's Office, David L. McPherson II, 35, of 872 Bull Run Road, Waverly, was arrested Friday in Marietta Municipal Court on the third-degree felony charge. He remains in custody at the Washington County Jail on a $15,000 bond.

An affidavit of facts filed with the court by Belpre police says McPherson was found unconscious in the driver's seat of a 1979 Dodge station wagon at the scene of a head-on collision Nov. 17 at Stone Road and Campus Drive. McPherson, the driver of the other vehicle and that woman's 7-year-old grandchild were taken to Camden-Clark Medical Center's Memorial Campus as a result of the crash. The extent of their injuries was not specified in the affidavit.

The affidavit says McPherson denied driving the vehicle and claimed the person who was behind the wheel fled the scene. But witnesses stated he had just left a residence in the 700 block of Elm Street, where he had been drinking, prior to the crash, the affidavit says.

McPherson was originally charged with operating a vehicle while intoxicated, no operator's license, no seat belt, expired tags and left of center, all misdemeanors. After consulting with the Washington County Prosecutor's Office, the charges were refiled with the felony aggravated vehicular assault charge in place of OVI.
