I know there is abuse of liability laws as they exist, BUT, I feel: Tort action is one of the few remidies remaining that the "common" person has against the very powerfull corporate influences, and do not need to be restricted any further than they allready have been.

For what it's worth about your brother: They are attempting to shield their assets by declaring bankruptsy, and transferring their assets to a sister company. A questionable move at best, and subject to interpretation by the courts. It will take a long time to hammer the complexities out, but hopefully they will not be permitted to get away scott free.

This is a prime example of why we do NOT need more "tort reform" that reduces corporate liability for their misdeeds.
